Service Terms & Conditions

All agreements are entered into between Mobile Welding Group Ltd (“the Company”) and the Client.

  1. Quotations, Information & Design Services
When requesting a quotation, the Client shall provide all necessary work details, measurements, photographs and/or drawings. The Company shall rely on such information as accurate for the purpose of any quotation given.

Where design services are required, these will be quoted separately. Design time (including amendments/variations) may be chargeable. No designs or drawings will be released until applicable fees or a fabrication deposit has been received. Fabrication will proceed only once the Client has approved the final design in writing; lead times run from the date of approval and receipt of deposit.

  2. Client-Supplied Specifications
Where the Client provides specifications, measurements or drawings and does not require the Company to undertake a site visit to obtain them directly, the Company accepts no responsibility for any inaccuracies and will rely on the details supplied when carrying out the requested fabrication work.

  3. Lead Times & Commencement of Work
Any lead times provided are estimates only and are not contractual. The Company will use all reasonable efforts to meet such estimates. Work shall commence only upon written acceptance of the Client’s order and, where an invoice for a deposit is issued, upon receipt of that deposit.

  4. Payment Terms
A 50% deposit is required to confirm all orders and prior to any fabrication or procurement, unless otherwise agreed in writing. Work will not commence until the deposit has cleared. The remaining 50% balance is due on completion of the work or upon delivery, whichever occurs first. Goods will not be released or dispatched until full payment has been received. Late payments may incur interest charges at 2% per week.

  5. Cancellation
The Client may cancel any contract within 14 days. However, the Client remains liable for any design work, materials ordered, or labour costs incurred where the Company has commenced work during that period.

  6. Inspection & Acceptance
Upon delivery of fabricated materials and/or completion of installation, the Client shall inspect the work to ensure it meets the agreed specifications. If no complaint is raised in writing within three (3) working days, the goods and/or services shall be deemed accepted.

  7. Workmanship Warranty
Where applicable, welding and metal fabrication works carried out by the Company shall be covered by a 12-month workmanship warranty from the date of completion, unless otherwise agreed in writing by both parties.

The warranty applies only to defects arising directly from the Company’s workmanship and covers faults confirmed to be caused solely by poor workmanship under normal and intended use conditions. Any materials required for remedial works may be chargeable unless otherwise agreed in writing.

This warranty excludes fair wear and tear, misuse, structural movement, impact, external factors, and any alterations or repairs carried out by third parties.

    7.1 Exclusions
    This warranty does not cover:
    • Normal wear and tear
    • Damage caused by misuse, impact, vandalism, or alterations by third parties
    • Corrosion caused by environmental conditions, lack of maintenance, or exposure to chemicals, salt, or moisture beyond normal conditions for the installation location, including coastal, industrial, or high-moisture environments
    • Surface finishes, including paint or coatings, unless a specific coating warranty has been agreed in writing
    • Structural movement of buildings, ground movement, or existing defects in walls, floors, or fixings
    • Materials supplied by the Client

    7.2 Site Conditions
The Company is not responsible for defects or damage caused by underlying site conditions that were not reasonably foreseeable at the time of installation, including uneven surfaces, hidden services, weak substrates, or existing structural issues.

Any remedial works required due to such conditions shall be treated as additional works and charged accordingly.

    7.3 Maintenance & Automation
The Client is responsible for routine maintenance. Where automated systems are installed, it is the Client’s responsibility to ensure regular documented maintenance from the date of installation. Failure to maintain the system or provide service records may invalidate the warranty.

  8. Limitation of Liability

The Company’s maximum liability in any circumstances shall not exceed the amount paid by the Client for the relevant job. The Company shall not be liable for any consequential or indirect losses.

  9. Site Protection, Visits & Access
Where there is a risk to the interior or surroundings, the Client shall take all necessary precautions to prevent damage. The Company shall exercise reasonable care but shall not be responsible for damage caused despite such care.

If the Client requests a site visit to verify measurements, a charge may apply (confirmed in writing beforehand). If an installation or visit is abortive for any reason outside the Company’s control (including lack of access or site readiness), additional visits will be chargeable.

  10. Weld Certification
The Company does not guarantee that welds will pass any third-party or CWI inspection or certification unless expressly agreed in writing. Any remedial work following testing shall be quoted and charged separately.

  11. Scrap & Waste
In the case of repair or replacement work, any removed sections, scrap or surplus material shall remain on site for disposal by the Client unless the Company agrees, for an additional charge, to remove them.

  12. Right to Remedy
The Client shall allow the Company a reasonable opportunity to remedy any complaint or defect.

  13. Title to Goods
Ownership of any goods supplied shall remain with the Company until payment has been made in full.

  14. Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control.

  15. Governing Law & Consumer Rights
Nothing in these Terms affects the Client’s statutory rights. This Agreement shall be governed by and construed in accordance with the laws of England, and the courts of England shall have exclusive jurisdiction.
